Privacy Policy

This Privacy Policy describes how and when I collect, use, and share information when you visit my website, purchase an item from me, contact me, or otherwise use my services through Etsy.com, Folksy.com or their related sites and services, directly through my own website and via email. By contacting me in any way via my website, Etsy, Folksy or email or by placing an order you are agreeing to the terms set out in this privacy policy with regard to collection, storage, sharing, processing and the transferring of your data.

This Privacy Policy doesn’t apply to the practices of third parties that I don’t own or control, including Etsy, Folksy, Create, Email or any third party services you access through Etsy or Folksy etc. You can reference the Etsy, Folksy, Create, Microsoft Outlook and Zoho Mail Privacy Policies to learn more about their privacy practices as well as of course your own email provider. All PayPal transactions are subject to the PayPal Privacy Policy. Other modes of payment will have their own privacy policies in place too, please reference their privacy policy directly to learn more about their privacy practices if you so wish.

To fulfil your order, you must provide me with certain information (which you gave directly to me or authorised Etsy/Folksy to provide me with), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom order for example), if you contact me directly.

If at any time my website has the shop function enabled it will be SSL encrypted. At other times it may not be.

I rely on a number of legal bases to collect, use, and share your information, including:

  • as needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support;
  • when you have provided your consent, which you may revoke at any time, such as by signing up for my mailing list;
  • if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
  • as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as

1) Providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and

2) Compliance with the Etsy/Folksy Seller Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Etsy/Folksy Seller Policy and Terms of Use.

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

  • Etsy and Folksy. I share information with Etsy and Folksy as necessary to provide you my services and comply with my obligations under both the Etsy and Folksy Seller Policy and Etsy and Folksy Terms of Use.
  • Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, for example delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.
  • Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.
  • Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

My website uses cookies to ensure you get the best experience, they basically make the website or service work, or help it to work more efficiently, as well as providing reporting information.  There are different types of cookies for example –

  • Essential Website / Session Cookies - These are strictly necessary cookies that enable a site to function as intended and are mainly used by online shops.
  • Analytical / Performance Cookies - These enable Create (my website provider) to monitor the performance of my site (page loading speeds, etc) to ensure that everything is functioning correctly. 
  • Functionality Cookies - These enable my customers to be recognised when they 
    return to the site to improve their user experience for example, if you have a user 
    account with me, it may remember your details so you can log in faster. 

Reporting information may include details about your computer spec/type, general internet usage and to provide statistical information including traffic, communication and location data and weblog statistics. This information is anonomised won’t identify you at all, it’s statistical data that builds an overall picture about my website’s visitors as a whole and how they generally interact with the site. This helps me to develop and improve the site for a better browsing/buying experience.  Cookies are automatically downloaded to your hard drive. All computers can decline cookies, you can do this by going to the setting on your browser which lets you decline cookies. If you decide to decline cookies, you might not be able to access parts of the website.

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 6 years as required by HMRC.

If you opt in to receiving marketing emails/newsletters which may become available in the future I may contact you with information about goods and services similar to those which were the subject of a previous sale to you. I may contact you with details of new products and services I offer. I may contact you with news that may be of interest to you about my business. I may use your information to tell you about any changes to my website – for example improvements or changes that may affect my service. You may opt out at any time.

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited casesI describe these rights below:

  • Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
  • Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.
  • Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
  • Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

To access, change, restrict or delete your data I may charge a £10 admin fee in order to process your request, this is purely to cover my time in doing so and is at my discretion dependent on how much work is involved.

 I will not sell or share your data in any other way than is stated in the privacy policy. I take all reasonable steps to ensure your data is stored in a secure manner. The transmission of information via the internet is obviously not completely secure so I can’t guarantee the security of any data sent to me electronically, the transmission of data is entirely at your own risk. Please check back from from time to time as this privacy policy may be updated.
